Terms & Conditions for Hotel Accommodation

Article 1. Scope of Application

  • 1.1. These Terms and Conditions shall govern any accommodation agreements or any other related contracts entered into between the hotel and the guest (including guests using rooms for teleworking within the day, etc.; the same shall apply hereinafter). Any matters not stipulated in these Terms and Conditions shall be governed by the laws and regulations, as well as generally established customs.
  • 1.2. Any usage guidelines and precautions (hereinafter collectively referred to as the “Rules”) presented by the hotel in connection with these Terms and Conditions shall, in addition to the Hotel Rules and Regulations established by the hotel and kept in guestrooms, constitute a part of these Terms and Conditions.
  • 1.3. Notwithstanding the preceding paragraph, any special agreements provided by the hotel within the scope permitted by law and customs shall take precedence.

Article 2. Application for an Accommodation Agreement

  • 2.1. Those applying for an accommodation agreement at the hotel shall provide the hotel with the following information:
    • (1) Guest name and telephone number;
    • (2) The date of stay and estimated time of arrival;
    • (3) Accommodation fees (generally based on the Basic Accommodation Fees in Appendix 1);
    • (4) Other information the hotel deems necessary.
  • 2.2. In the event that a guest requests to extend their stay beyond the date listed in Paragraph 1(2), an application for a new accommodation agreement shall be deemed to have been made at the time the request was made.

Article 3. Establishment of the Accommodation Agreement

  • 3.1. The accommodation agreement shall be established when the hotel accepts the application set forth in the preceding article. However, this shall not apply when the hotel proves that it has not accepted the application.
  • 3.2. When an accommodation agreement has been established pursuant to the preceding paragraph, the guest shall pay a deposit set by the hotel by the deadline designated by the hotel.
  • 3.3. The deposit shall first be allocated to room charges ultimately payable by the guest, then allocated to fines, followed by compensation for damages in the event that the provisions of Articles 6 and 21 apply. Any remaining deposit shall be returned at the time of payment in accordance with Article 12.
  • 3.4. The accommodation agreement shall cease to be effective when the guest fails to pay the deposit set forth in Paragraph 2 by the deadline designated by the hotel. However, this is limited to cases in which the hotel has notified the guest of the deposit payment deadline.

Article 4. Special Agreements Not Requiring a Deposit

  • 4.1. Notwithstanding the provisions of Paragraph 2 of the preceding article, the hotel may accept special agreements that do not require payment of a deposit.
  • 4.2. The preceding paragraph shall apply when the hotel does not request payment of the deposit set forth in Paragraph 2 of the preceding article, or does not specify a deposit payment deadline when accepting an application for an accommodation agreement.

Article 4-2. Request for Cooperation in Measures to Prevent Infection in the Facility

The hotel may request cooperation from a potential guest in accordance with the provisions of Article 4-2, Paragraph 1 of the Hotel Business Act (Act No. 138 of 1948).

Article 5. Refusal of Accommodation Agreements

The hotel may refuse to enter into an accommodation agreement in the following cases. However, this provision does not mean that the hotel may refuse accommodation for cases that are not listed in Article 5 of the Hotel Business Act:

  • 5.1. When the accommodation application violates the stipulations of these Terms and Conditions;
  • 5.2. When guestrooms are fully booked;
  • 5.3. When a potential guest is deemed likely to break the law, disrupt public order, or act contrary to public morals during their stay;
  • 5.4. When a potential guest is deemed to fall under any of the following categories:
    • a. An organized crime group under the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) as stipulated in Article 2(2), a member of an organized crime group as stipulated in Article 2(6), an associate member or affiliate of an organized crime group, or any other antisocial force;
    • b. When the applicant is involved in corporations or other organizations whose operations are controlled by an organized crime group;
    • c. When any of the directors of the applicant’s corporation is classified as a member of an organized crime group;
  • 5.5. When the potential guest’s behavior poses a significant nuisance to other guests;
  • 5.6. When a potential guest is a patient of a specified infectious disease pursuant to the provisions of Article 4-2, Paragraph 1(2) of the Hotel Business Act;
  • 5.7. When the potential guest uses violence, threats, blackmail, or intimidation to make unjust or unreasonable demands against the hotel or its employees (excluding cases where the guest is requesting to eliminate social barriers pursuant to the Act for Eliminating Discrimination against Persons with Disabilities), or is deemed to have engaged in any similar acts in the past;
  • 5.8. When the potential guest repeatedly makes requests pursuant to the provisions of Article 5-6 of the Hotel Business Act, imposing an excessive burden and significantly hindering the provision of hotel services to other guests;
  • 5.9. When the hotel is unable to accommodate guests due to natural disaster, facility malfunction, or other unavoidable circumstances;
  • 5.10. When the potential guest is intoxicated, exhibits or has exhibited extremely abnormal behavior that may pose a nuisance to other guests, or in cases that fall under the provisions of prefectural ordinances;
  • 5.11. When the potential guest is extremely unsanitary or is wearing extremely dirty clothes that may cause a nuisance to other guests;
  • 5.12. When the potential guest conceals the fact that they have reserved a guestroom within the hotel for the purpose of making a profit, either for themselves or for a third party, by selling goods, etc.;
  • 5.13. When the potential guest does not comply with these Terms and Conditions or with the cancellation and payment policies when making a reservation.

Article 5-2. Explanation of Refusal to Conclude an Accommodation Contract

A person seeking accommodation may request an explanation of the reasons for refusal if the hotel refuses to conclude an accommodation contract in accordance with the preceding article.

Article 6. The Guest’s Right to Terminate the Accommodation Agreement

  • 6.1. Guests may request that the hotel terminate the accommodation agreement.
  • 6.2. If the accommodation agreement is terminated in whole or in part for reasons attributable to the guest, the hotel shall charge a penalty in accordance with the provisions of Attached Table 2 (only in cases where the hotel specifies a deposit payment deadline and requests payment as stipulated in Article 3(2), excluding cases in which the guest cancels the accommodation agreement prior to such payment). However, where the hotel has accepted a special agreement pursuant to Article 4(1), guests shall only be required to pay a cancellation penalty if they have been notified of such obligation.
  • 6.3. If the guest does not arrive by 10:00 p.m., or within two hours after the scheduled arrival time arranged in advance on the day of their stay, without notifying the hotel, the accommodation agreement may be deemed to have been terminated by the guest.

Article 7. The Hotel’s Right to Terminate the Accommodation Agreement

  • 7.1. The hotel may terminate the accommodation agreement in the following cases. However, this provision does not mean that the hotel may refuse accommodation for cases that are not listed in Article 5 of the Hotel Business Act:
    • (1) When the guest is deemed likely to break the law, disrupt public order, or act contrary to public morals, or has engaged in such acts during their stay;
    • (2) When the guest is deemed to fall under any of the following: a. an organized crime group or a member, associate member, or affiliate of an organized crime group, or any other antisocial force; b. corporations or other organizations whose operations are controlled by an organized crime group; c. a corporation any of whose directors is classified as a member of an organized crime group;
    • (3) When the guest’s behavior poses a significant nuisance to other guests;
    • (4) When the guest is a patient of a specified infectious disease;
    • (5) When the guest uses violence, threats, blackmail, or intimidation to make unjust or unreasonable demands against the hotel or its employees (excluding cases where the guest is requesting to eliminate social barriers pursuant to the Act for Eliminating Discrimination against Persons with Disabilities), or is deemed to have engaged in any similar acts in the past;
    • (6) When the guest repeatedly makes requests pursuant to the provisions of Article 5-6 of the Hotel Business Act that would impose an excessive burden and significantly hinder the provision of hotel services to other guests;
    • (7) When the guest cannot be accommodated due to force majeure;
    • (8) When the guest is intoxicated, exhibits or has exhibited extremely abnormal behavior that may pose a nuisance to other guests, or in cases that fall under the provisions of prefectural ordinances;
    • (9) When the guest smokes in bed, tampers with firefighting equipment, or otherwise violates the Hotel Rules and Regulations (limited to fire-related regulations);
    • (10) When the guest conceals the fact that they have reserved a guestroom within the hotel for the purpose of making a profit, either for themselves or for a third party, by selling goods, etc.;
    • (11) When the guest violates the Hotel Rules and Regulations stipulated in Article 9, commits any of the prohibited acts set forth in Article 10, or otherwise fails to comply with these Terms and Conditions or with the rules on cancellation and payment when making a reservation.
  • 7.2. When the hotel terminates the accommodation agreement in accordance with the preceding paragraph, the guest shall not be charged for services not yet provided.

Article 7-2. Explanation of Cancellation of Accommodation Contract

In the event that the hotel cancels the accommodation contract in accordance with the preceding article, the guest may request an explanation of the reasons for the cancellation.

Article 8. Guest Registration

  • 8.1. Guests shall register the following information at the front desk on the day of their stay:
    • (1) Guest name, age, gender, address, and contact telephone number;
    • (2) Departure date and planned departure time;
    • (3) Other information deemed necessary by the hotel.
  • 8.2. International guests who do not have an address in Georgia shall present a scan or copy of their passport and register their nationality, passport number, port of entry, and immigration date, in addition to the information listed in Paragraph 1.
  • 8.3. Guests wishing to pay the fees stipulated in Article 12 using traveler’s checks, hotel vouchers, credit cards, or any other alternative to currency shall present such payment method in advance when registering the information above. Currency payment shall not be accepted if the hotel has notified the guest in advance that such payment is not accepted.

Article 9. Compliance with the Hotel Rules and Regulations

Guests shall comply with these Terms and Conditions, as well as the Hotel Rules and Regulations, during their stay at the hotel.

Article 10. Prohibited Acts

  • 10.1. Guests shall not engage in any of the following acts, either personally or through the use of a third party:
    • (1) Registering or providing false information when staying at the hotel;
    • (2) Using fraudulent payment methods, such as stolen credit cards, when staying at the hotel;
    • (3) Unauthorized acquisition or use of Merebashvili Estate membership benefits or personal information belonging to a third party;
    • (4) Using the hotel for business purposes without permission from the hotel;
    • (5) Mass booking followed by mass cancellation, or any similar acts;
    • (6) Repeatedly making and canceling bookings without a justifiable reason, or any similar acts;
    • (7) Impersonating the hotel or the hotel group, or engaging in any act that could reasonably be mistaken for such;
    • (8) Unauthorized access to systems or computers, or any similar acts;
    • (9) Sending or uploading harmful computer programs, or any similar acts;
    • (10) Removing, defacing, or destroying equipment within the hotel facilities, or any similar acts;
    • (11) Obstructing business operations or damaging the reputation or brand of the hotel or hotel group by making demands that exceed socially acceptable norms, or by slandering, defaming, threatening, or harassing hotel staff, posting inflammatory remarks on social networking sites, or engaging in any similar acts;
    • (12) Violence, threats, extortion, or other coercive and unreasonable demands against the hotel or its staff;
    • (13) Any act that causes or risks causing inconvenience, damage, or disadvantage to other guests, third parties, the hotel, or the hotel group;
    • (14) Any act that infringes or risks infringing copyrights, trademarks, intellectual property rights, privacy rights, personal rights, or any other rights of other guests, third parties, the hotel, or the hotel group;
    • (15) Any act that violates or risks violating public order or the law, including criminal acts;
    • (16) Displaying the power of an organized crime group or aiding and abetting an organized crime group;
    • (17) Violating any other provision of these Terms and Conditions;
    • (18) Violating any other rule contained in the Hotel Rules and Regulations;
    • (19) Any other act deemed inappropriate by the hotel.
  • 10.2. The hotel shall be entitled to claim compensation from the guest for any damages incurred as a result of the acts described in the preceding paragraph.

Article 11. Hours

  • 11.1. Hours for the front desk, cashier, and other major hotel facilities are as follows. For detailed information regarding the operating hours of other facilities, please refer to the attached pamphlet, signs displayed throughout the hotel, or the service directory available in the guestrooms:
    • (1) Front entrance closing time: 22:00
    • (2) Front desk: 22:00
    • (3) Cashier: 22:00
  • 11.2. The operating hours specified in the preceding paragraph may be temporarily changed when necessary and unavoidable. The hotel shall take appropriate measures to notify guests of such changes.

Article 12. Payment of Fees

  • 12.1. A breakdown of the accommodation fees payable by guests is provided in Appendix 1.
  • 12.2. The accommodation fees referred to in the preceding paragraph shall be paid at the front desk on the day of the guest’s arrival or upon the hotel’s request, using Georgian currency, traveler’s checks, hotel vouchers, credit cards, or any other payment method accepted by the hotel. However, currency payment shall not be accepted if the hotel has notified the guest in advance that such payment is not accepted.
  • 12.3. The accommodation fee shall remain payable even if the guest voluntarily chooses not to stay in an available room provided by the hotel.
  • 12.4. Guests using accommodation plans that include breakfast, lunch, dinner, or other ancillary services shall be charged for such services even if they are not used, unless otherwise specified in the applicable accommodation plan.

Article 13. Hotel Liability

  • 13.1. The hotel shall compensate the guest for any damages arising from the failure to perform the accommodation agreement or any related agreements. However, this shall not apply where such damages are caused by reasons not attributable to the hotel.
  • 13.2. The hotel’s responsibility to provide accommodation begins when the guest completes check-in at the hotel front desk and ends at the designated checkout time.
  • 13.3. The hotel maintains hotel liability insurance to protect against fire and other disasters.

Article 14. When Rooms Cannot Be Provided According to the Agreement

  • 14.1. If the hotel is unable to provide a guestroom in accordance with the accommodation agreement, the hotel shall, with the guest’s consent, make every reasonable effort to arrange accommodation at another hotel under conditions as similar as possible.
  • 14.2. Notwithstanding the preceding paragraph, if the hotel is unable to arrange alternative accommodation, it shall pay compensation equivalent to the applicable cancellation penalty, which shall be allocated as damages. However, such compensation shall not be payable where the inability to provide accommodation is due to reasons not attributable to the hotel.

Article 15. Housekeeping

  • 15.1. When a guest stays in the same room for two or more consecutive nights, housekeeping shall be performed only upon the guest’s request.
  • 15.2. Even if the guest requests that housekeeping not be performed, the hotel shall clean the guestroom every fourth night in order to maintain sanitary conditions. However, the hotel reserves the right to clean guestrooms at any time when deemed necessary.
  • 15.3. Guestrooms may also be entered on days other than scheduled cleaning days for maintenance, legal inspections, or emergencies. The guest may not refuse the housekeeping or room entry provided for in the preceding paragraph.

Article 16. Computer Networks

  • 16.1. Guests shall use the hotel’s computer networks at their own risk. Network services may be interrupted or discontinued without prior notice due to system failures or other reasons. The hotel shall not be liable for any loss or damage resulting from service interruptions caused by system failures or any other reason.
  • 16.2. If a guest uses the hotel’s computer networks in a manner deemed inappropriate by the hotel, or in a manner that causes or may cause damage, the hotel may require the guest to immediately cease such use and compensate the hotel for any damages incurred.

Article 17. Guest Liability

The guest shall compensate the hotel for any damages caused by the guest’s willful misconduct or negligence, including, but not limited to, facility repair costs and lost business opportunities.

Article 18. Exemptions

The hotel shall be exempt from liability where an exemption provided under these Terms and Conditions or the Hotel Rules and Regulations applies.

Article 19. Reporting to the Authorities

  • 19.1. If a guest’s violation of these Terms and Conditions or the Hotel Rules and Regulations requires the protection of the rights, property, or services of the hotel or another guest, the hotel may notify the police or other relevant authorities and take any other appropriate measures.
  • 19.2. If the hotel determines that a guest’s health or life is in serious danger, it may call an ambulance regardless of the guest’s wishes.

Article 20. Changes to the Agreement

  • 20.1. These Terms and Conditions may be amended without prior notice. Guests are advised to refer to the hotel’s official website for the latest version.
  • 20.2. Continued use of the hotel after any amendments to these Terms and Conditions shall constitute acceptance of the revised Terms and Conditions.
  • 20.3. Notwithstanding the preceding paragraph, accommodation agreements concluded prior to the effective date of any amendment shall remain subject to the Terms and Conditions in effect at the time such agreement was concluded.

Article 21. Governing Law and Court of Jurisdiction

  • 21.1. The accommodation agreement between the hotel and the guest shall be governed by the laws of Georgia.
  • 21.2. Any disputes arising out of or in connection with the accommodation agreement shall be subject to the exclusive jurisdiction of the competent courts of Georgia.

Appendix 2. Penalties

  • If the number of contracted nights is reduced, a cancellation fee equivalent to one day (the first night) shall be charged, regardless of the number of nights reduced.
  • For accommodation plans sold to groups (15 guests or more), separate cancellation policies established by the hotel may take precedence over these Terms and Conditions.
  • For accommodation contracts concluded under plans sold by partner companies via the Internet or other sales channels, the cancellation policies established by those companies may take precedence over these Terms and Conditions.
Hotel Rules and Regulations

Guests are requested to comply with these Hotel Rules and Regulations in order to maintain the hotel as a safe, comfortable, and orderly public accommodation facility (including daytime guests using rooms for teleworking, etc.; the same shall apply hereinafter).

Guests who fail to comply with these Rules may be refused further accommodation or use of the hotel’s facilities. The hotel may also require such guests to compensate for any damage caused to hotel property, fixtures, or equipment.

Prohibited Actions

Guests shall not engage in any of the following acts:

  • (1) Using guestrooms for purposes other than accommodation without prior permission from the hotel.
  • (2) Using open flames for heating or cooking in guestrooms, corridors, or other common areas.
  • (3) Smoking in non-smoking rooms (including e-cigarettes, heated tobacco products, etc.). If evidence of smoking is found in a non-smoking room, the guest shall be charged 200 GEL as a room cleaning fee and room damage compensation in addition to the room charge. Smoking in bed or other areas with a fire risk is prohibited even in designated smoking rooms.
  • (4) Meeting outside visitors anywhere other than the hotel lobby, or inviting outside visitors into guestrooms.
  • (5) Moving furniture, equipment, or fixtures from their designated locations without authorization.
  • (6) Altering or modifying hotel facilities or guestroom equipment without permission.
  • (7) Entering storage rooms, machinery rooms, emergency staircases (except during emergencies), or other staff-only areas.
  • (8) Bringing any of the following items into the hotel:
    • a. Dogs (except certified assistance dogs), cats, birds, or other pets;
    • b. Items emitting foul or strong odors;
    • c. Excessively heavy items or an excessive quantity of belongings;
    • d. Guns, swords, or other weapons;
    • e. Explosives, volatile oils, or other flammable or combustible materials;
    • f. Any other item deemed by the hotel to pose a risk to the safety of guests.
  • (9) Shouting, singing loudly, causing excessive vibration or disturbance, or engaging in any conduct that inconveniences or disturbs other guests.
  • (10) Gambling, immoral conduct, or any act that disturbs public order or safety.
  • (11) Distributing advertisements or promotional materials, selling goods, or conducting business activities without prior permission.
  • (12) Distributing leaflets, collecting signatures, engaging in political or religious activities, holding meetings, displaying organizational influence, or assisting such activities without authorization.
  • (13) Bringing or parking propaganda vehicles, modified vehicles, or any other vehicle that may inconvenience or disturb other guests.
  • (14) Leaving personal belongings in corridors or the lobby.
  • (15) Taking photographs or videos that may disturb other guests.
  • (16) Photographing or filming the hotel’s interior for commercial purposes without prior authorization.
  • (17) Assault, bodily injury, threats, extortion, fraud, obstruction of business, intimidation, unreasonable demands, or similar conduct.
  • (18) Any other act deemed inappropriate by the hotel.

Precautions

  • (1) As a general rule, items deposited with the hotel shall be disposed of after three (3) months from the date of deposit unless otherwise specified.
  • (2) As a general rule, the hotel will await instructions from the owner regarding lost or found property. If no instructions are received, or if the owner cannot be identified: valuables and items containing personal information shall be delivered to the nearest police station; other items shall be disposed of three (3) months after discovery; food, beverages, cigarettes, magazines, and other perishable or unsanitary items shall be disposed of on the same day.
  • (3) Guests should note that use of the guestroom telephone for external calls may incur a facility usage fee.
  • (4) Housekeeping shall be performed only upon request. However, guestrooms shall be cleaned every fourth night to maintain sanitary conditions, and the hotel reserves the right to enter guestrooms for maintenance, inspections, or emergencies.
  • (5) Where necessary to protect the rights, property, or services of the hotel or another guest, the hotel may notify the police or other competent authorities.
  • (6) If the hotel determines that a guest’s health or life is in serious danger, it may call an ambulance regardless of the guest’s wishes.
  • (7) If a room key is lost and not returned by checkout, the guest shall be charged 50 GEL for replacement.
  • (8) External telephone calls will only be connected when the guest’s name and room number match. Guests with special call-handling requests should notify the front desk in advance.

Refusal of Service

Service may be refused to the following persons or organizations:

  • (1) The following organizations or individuals:
    • a. Organized crime groups and their members, affiliates, or other persons involved in organized crime;
    • b. Individuals involved in corporations or organizations controlled by organized crime groups;
    • c. Antisocial organizations and their members or affiliates.
  • (2) Individuals who, due to diminished capacity or the influence of drugs, are unable to ensure their own safety and whose conduct may pose a risk to, or cause fear or discomfort for, other guests.
  • (3) Individuals who fail to immediately cease any prohibited conduct after receiving a warning from the hotel.
